A Clear Path Through an Unfamiliar Process

Most people do not deal with probate very often. When a parent, spouse, or other family member dies, the legal process can feel like one more burden at a time when there is already plenty to handle.

My job is to help you understand what needs to be done, identify the important deadlines and responsibilities, and guide you through the process without creating unnecessary complication.

In a standard, uncontested estate, probate should be a process to manage — not a crisis.

What Should I Do First?

Not everything has to happen immediately. The first step is usually to gather information and determine what kind of administration, if any, is actually necessary.

Locate the Will

If there is a Will, we need to review it, identify the nominated executor, and determine whether it should be admitted to probate.

Identify the Assets

We look at what the decedent owned, how those assets were titled, and whether any accounts pass directly by beneficiary designation or survivorship.

Understand the Debts

We identify known creditors, ongoing expenses, taxes, and other obligations that may need to be addressed during administration.

Determine Whether Probate Is Needed

Not every asset passes through probate, and not every estate requires the same process. Sometimes a simpler procedure may be available.

Protect Estate Property

Houses, vehicles, personal property, financial accounts, and important records may need to be secured while the estate is being sorted out.

Avoid Acting Too Quickly

Families often feel pressure to distribute property immediately. In many cases, it is better to understand the estate first and distribute later.

THE BASIC PROCESS

What Happens During Probate?

Every estate is different, but a routine Tennessee probate generally follows a recognizable path.

Open the Estate

The Will, if there is one, is presented to the court and the appropriate person is appointed to administer the estate.

Gather and Manage Assets

Estate assets are identified, collected, protected, and managed while administration is underway.

Address Creditors and Expenses

Proper claims and expenses are reviewed and paid in the appropriate order before final distributions are made.

Distribute the Estate

Once the estate is ready, remaining assets are distributed according to the Will or Tennessee intestacy law.

Close the Estate

Final paperwork is completed so the personal representative can be discharged and the estate formally concluded.

A COMMON QUESTION

Does Every Estate Have to Go Through Probate?

No. The answer depends largely on how the decedent’s assets were owned and whether beneficiaries were already designated.

Some Assets May Pass Outside Probate

Jointly owned property with survivorship rights, life insurance, retirement accounts, payable-on-death accounts, and assets held in a properly funded trust may pass directly to another person without probate.

Some Estates May Qualify for a Simpler Procedure

Depending on the type and value of the assets involved, Tennessee law may provide alternatives to a full probate administration. The first step is determining what actually belongs in the probate estate.
